Description of Service

eva365 provides appointment scheduling software that connects businesses with their customers, including booking management, notifications, and related tools. We may add, change, or remove features of the Service at any time.

Account Registration

To use certain features of the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Acceptable Use

You agree not to: - Use the Service for any unlawful purpose or in violation of these Terms - Attempt to gain unauthorised access to the Service or other users' accounts - Interfere with or disrupt the integrity or performance of the Service - Upload or transmit any content that is unlawful, harmful, or infringes another person's rights

Appointments & Bookings

eva365 provides the platform that enables businesses and customers to schedule appointments; we are not a party to the underlying agreement between a business and its customer. Businesses are responsible for the accuracy of their availability, services, and pricing, and for honouring bookings made through the Service.

Subscriptions, Fees & Payment

Some features of the Service may require a paid subscription. Fees, billing cycles, and payment terms will be presented to you at the time of purchase. Unless stated otherwise, fees are non-refundable except as required by law or as expressly stated in these Terms.

Cancellations & Refunds

You may cancel a paid subscription at any time; the cancellation will take effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable consumer law.

Intellectual Property

The Service, including its software, design, and content (excluding content you provide), is owned by eva365 or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, eva365 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service.

Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we reasonably believe doing so is necessary to protect the Service or other users. You may also stop using the Service and close your account at any time.

Governing Law

These Terms are governed by the laws of Australia, without regard to its conflict-of-law principles. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the Australian courts.

Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
